1. Definitions
"Company," "We," "Us," "Our": Refers to MAL Property Maintenance & Electrical Ltd., a family-run property maintenance company operating in Ireland.
"Client," "You," "Your": Refers to the individual, company, or entity engaging our services or using our Website.
"Services": Refers to all property maintenance and energy services offered by MAL Property Maintenance, including but not limited to General Maintenance, Electrical Maintenance (Residential & Commercial), Plumbing and Decorating, Emergency Repairs, Renovations and Improvements, Solar Panel Installation, EV Charger Installation, Battery Storage Systems, Attic Insulation, Cavity Wall Insulation, Heat Pump Systems, Windows & Doors Installation, and BER Assessments.
"Quote": A written estimate provided by the Company detailing the cost of proposed Services.
"Agreement": The contract formed between the Company and the Client for the provision of Services, governed by these Terms.
2. Services
MAL Property Maintenance agrees to provide the Services as described in the mutually agreed-upon Quote or service agreement. All Services will be performed with reasonable care and skill, in a professional and workmanlike manner.
3. Quotes and Pricing
- All Quotes provided by MAL Property Maintenance are valid for a period of 28 days from the date of issue, unless otherwise stated.
- Quotes are based on the information provided by the Client and a site survey (if applicable). Any significant changes to the scope of work, site conditions, or materials required after the Quote has been accepted may result in additional charges.
- We reserve the right to revise Quotes if unforeseen circumstances or additional work become necessary during the provision of Services, with prior notification and agreement from the Client.
4. Online Platform and Quote System
- Quotes generated through our website or online quote system are estimates only. All online quotes are subject to confirmation following a site visit by one of our team members.
- Prices shown on the website are indicative and may vary based on actual site conditions, access requirements, property characteristics, and material costs at the time of work.
- Use of our online platform, including account creation and the client portal, is subject to these Terms. You are responsible for maintaining the confidentiality of any login credentials associated with your account.
- We reserve the right to modify, suspend, or discontinue any aspect of the online platform at any time without prior notice.
5. Payment Terms
- Payment terms will be specified in your Quote or invoice. Unless otherwise agreed in writing, a deposit may be required before commencement of work for larger projects.
- We offer the following payment plans, subject to agreement:
- 50/50: 50% deposit before commencement, 50% on completion.
- 30/30/40: 30% deposit, 30% at midpoint, 40% on completion.
- Final payment for Services rendered is due within 7 days of the invoice date, unless otherwise agreed in writing.
- Payments can be made via:
- Online (Stripe): Credit/debit card, Apple Pay, Google Pay
- Bank transfer: Bank of Ireland (BOI) or AIB
- Cash or cheque (by prior arrangement)
- For grant-eligible work, deposits are calculated on the client portion only (i.e., total cost minus the applicable SEAI grant amount).
- The Company reserves the right to charge interest on overdue accounts at a rate of 2% per month or part thereof, and to recover any debt collection costs incurred.
- In the event of non-payment, the Company reserves the right to suspend or cease further work until payment is received, and to remove any materials or equipment from the Client's property.
6. VAT
- All prices quoted are exclusive of VAT unless otherwise stated.
- VAT is applied at the prevailing rate:
- 13.5% for construction, maintenance, and installation services.
- 0% for the supply and installation of solar panels (as applicable under current Irish tax law).
- VAT rates are subject to change in accordance with Irish Revenue regulations. Any changes will be reflected in your final invoice.
7. SEAI Grants
- MAL Property Maintenance is a registered contractor with the Sustainable Energy Authority of Ireland (SEAI).
- Grant applications are the sole responsibility of the homeowner/Client. Applications must be submitted directly through seai.ie.
- While MAL Property Maintenance provides guidance and support throughout the grant process, we do not guarantee grant approval or any specific grant amount.
- Work cannot commence before the Client has received their Letter of Offer from SEAI. Any work carried out before the Letter of Offer is received may render the grant application invalid.
- If the Client chooses to proceed without a grant, or if their grant application is unsuccessful, the Client is responsible for the full cost of the Services.
- Grant payments are typically processed 4–6 weeks after completion of works and submission of all required documentation. Payment is made by SEAI to the nominated bank account as specified in the grant application.
- SEAI grants are subject to an 8-month validity period from the date of the Letter of Offer. It is the Client's responsibility to ensure works are completed within this timeframe.
- MAL Property Maintenance is not liable for grant rejections, delays in grant processing, changes to grant schemes or amounts, or any losses arising from the grant application process.
8. Cancellations and Rescheduling
- If the Client wishes to cancel or reschedule Services, they must notify MAL Property Maintenance as soon as possible.
- Cancellations made less than 48 hours before the scheduled service time may incur a cancellation fee of 50% of the service cost or a fixed call-out fee, especially if resources have already been allocated.
- Deposits paid for Services may be non-refundable or partially refundable depending on the notice period and costs incurred by the Company.
9. Client Responsibilities
- The Client must provide accurate and complete information regarding the property and the Services required.
- The Client must ensure safe and clear access to the work area for our team and equipment.
- The Client is responsible for ensuring that any necessary permits, approvals, or permissions from local authorities or property management are obtained prior to the commencement of Services, unless otherwise agreed in writing.
- The Client must secure any pets or valuables from the work area.
- The Client must notify the Company of any known hazards or risks on the property.
10. Liability
- MAL Property Maintenance carries public liability insurance. While we take all reasonable precautions, we shall not be liable for any loss, damage, or injury to persons or property arising from circumstances beyond our reasonable control.
- Our liability for any direct loss or damage arising from our negligence or breach of these Terms shall be limited to the value of the Services provided.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or data.
11. Warranties and Guarantees
- We guarantee our workmanship for a period of 3 months from the completion date of the Services, unless otherwise stated in the Quote or specific service terms (e.g., solar panel warranties).
- Any materials or products supplied by the Company are subject to the manufacturer's warranty.
- This guarantee does not cover damage caused by misuse, neglect, third-party interference, acts of nature, or normal wear and tear.
12. Notifications and Communications
- We communicate with Clients via email, WhatsApp, and push notifications (where enabled). By providing your contact details and using our Services, you consent to receiving communications through these channels.
- You may opt out of non-essential communications (such as marketing messages) at any time by contacting us or using the unsubscribe mechanism provided.
- Essential service communications (e.g., appointment confirmations, invoices, and safety notices) cannot be opted out of while you have active Services with us.
13. Intellectual Property
All content on this Website, including text, graphics, logos, images, and software, is the property of MAL Property Maintenance or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.
14. Privacy Policy
Your privacy is important to us. By using our services and Website, you consent to our data practices as described in our Privacy Policy.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
16. Changes to Terms
MAL Property Maintenance reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of our services or Website after any such changes constitutes your acceptance of the new Terms.
